From 2026-08-01, where an advertisement uses artificial intelligence or other software in a way that significantly affects consumers' economic behaviour regarding a good or service, or includes digital characters created with AI technologies that cannot be distinguished from humans, this must be stated clearly, understandably and distinguishably (Commercial Advertising and Unfair Commercial Practices Regulation art. 18(8), added by the amending regulation of RG 33297, madde 6). The Regulation covers every commercial advertisement aimed at consumers (art. 2) and binds advertisers, advertising agencies, media organisations and everyone involved in advertising (art. 1).   • Duty falls on: any person
  • Advertisers, advertising agencies, media organisations and others involved in commercial advertising aimed at consumers in Turkey, including ad-generation tools, where an advertisement uses AI in a way that significantly affects consumers' economic behaviour or includes AI-created digital characters indistinguishable from humans. Applies from 2026-08-01. Whether a given AI use 'significantly affects' economic behaviour is for counsel.
  • Whether it applies depends on facts outside the code; a person has to decide.

The guard to add

Add a clear 'synthetic performer' disclosure to every generated ad that features an AI avatar, presenter or human-like voice.

The ad-composition pipeline marks an ad as containing a synthetic performer whenever it inserts an AI avatar, digital human or synthetic voice; the renderer then overlays a legible disclosure ('This performance features a synthetic performer' / 'No human performer is depicted'; in Turkey a clear, distinguishable statement that AI is used), for the whole time the performer is on screen where required, and the export refuses an ad that is marked but undisclosed. Translation or accessibility-only uses are recorded as such.

What this provision adds:

  • The statement must be clear, understandable and distinguishable (açık, anlaşılır ve ayırt edilebilir).
