Kyrgyzstan's Digital Code lets subjects of the digital environment automate decisions so that results of processing digital data arise and are applied to create, change or end legal relations without human participation (Art. 57(1); Art. 1(1)). Data principals whose interests are affected by automatic decisions that produce legal consequences for them or similarly significantly affect them may demand that the subject using them (1) stop taking automatic decisions about them and (2) review, with human participation, automatic decisions taken earlier (Art. 57(2)). Detect a model output that becomes a decision about a person with no stop-automation check and human re-review route, and no human decision.

Who it applies to

  • Duty falls on: any person
  • Systems covered: automated decision, consequential decision
  • Any subject of the digital environment in the Kyrgyz Republic that takes automatic decisions affecting data principals' interests with legal or similarly significant effects. In force from 2026-02-06 (Law No. 179, Art. 1: six months from official publication of that Law on 5 August 2025) for relations arising after that date (Art. 3(1)). Art. 57(3) adds sector-specific requirements set elsewhere in the Code (not encoded).
  • Not covered:
    • Decisions with human participation are not automatic decisions (Arts. 1(1), 57(1))
    • Decisions with neither legal consequences nor a similarly significant effect on the data principal (Art. 57(2))
  • Whether it applies depends on facts outside the code; a person has to decide.

The guard to add

Route significant automated decisions through meaningful human review, or wire in an automated-decision notice, reasons, human intervention, a way to give a view, and contest.

At the point where model output becomes a significant decision about a person (approve, deny, underwrite, set_status), either queue the case for a reviewer who weighs the evidence and can change the outcome before it takes effect (review_queue.enqueue, requires_human_review), or, where the decision stays solely automated, record the permitted basis for that decision type and wire the safeguards in. Those safeguards are a notice in the decision message that it was made by automated processing, reasons the person can read, and request_human_review or contest routes where the person can give their view and have a human reconsider. A reviewer who approves every case without examining it does not make the decision non-automated, so the review records reviewer identity, the evidence viewed, and the outcome.

What this provision adds:

  • On the person's demand, stop taking automated decisions about them (store and check the preference before any model call) and review earlier automated decisions with a human.
