Control
A child below the national age threshold uses an AI feature without the consent of a parent or guardian
Where a law sets an age below which a child's access to AI technology, and the processing of the child's data that follows, needs the consent of whoever holds parental responsibility, an AI feature must not open to a user below that age until that consent is recorded.
Informational data, not legal advice. Summaries and rules have not been reviewed by a lawyer: always verify official law text for decisions. A suggested guard is intended to address each rule; adding it is not a statement of compliance to that law.

Trust and provenance
How far the rules this guard addresses have been checked. Each rule links to its provision, with its citation, official text and its own panel.
- This control
- Audit-grade: meets all 3 checks of the TwinEthos audit standard that apply to it.
- Lanes
- Binding law — in force 1
- Verification
- Sources last verified 3 Oct 2026; each provision states how.
- Data release
- Data release 2026.10.03.3, data as of 3 Oct 2026, schema 0.3.9.
- Legal review
- None of the 1 rule has been reviewed by a lawyer; no TwinEthos rule has been legally reviewed yet. Treat each as research to check against the official text; it is not legal advice. Open questions for counsel on them: 1.
- Audit standard
- 1 of 1 rule audit-grade. The audit standard is TwinEthos's own quality bar for provenance, dates, applicability, detectors, fixtures, remediation and licences; it is not a legal review.
- Detectors
- 2 detectors, all experimental: written from the rule's text and not yet measured for precision on real code, so treat a hit as a lead to verify. Each provision lists its detectors' known limits.
The guard to add
Gate every AI feature on an age check and, for a user below the legal threshold, on a verified parental or guardian consent record.
Determine age at sign-up or first use of the AI feature (date of birth, an age-assurance result, or the account type), store it on the account, and check it in the request handler or middleware that fronts the model call. For a user below the threshold (14 in Italy), require a consent record from the parent or guardian (who consented, when, how they were verified, which AI features and processing it covers) and return a consent-pending response instead of calling the model when it is missing or withdrawn. Users at or above the threshold but under 18 may consent themselves only where the information on the processing is easy to find and written for them.
Where it goes: 1 application source code, 2 data models, 9 AI output handling, 14 user-facing text.
What reviewers look for: an age field or age-assurance result on the user model, and in the AI route a check of it that, for a user under the threshold, requires a parental consent record (parental_consent, guardian_consent, consenso_genitori) before the model call, with a consent-pending path when it is absent.
Example (FastAPI + OpenAI SDK), before:
@app.post('/tutor')
def tutor(body: Ask, user=Depends(current_user)):
age = years_since(user.birth_date)
r = client.chat.completions.create(model=MODEL, messages=build(body, age))
return {'reply': r.choices[0].message.content}After:
MIN_AGE_WITHOUT_PARENT = 14 # Law 132/2025 Art. 4(4)
@app.post('/tutor')
def tutor(body: Ask, user=Depends(current_user)):
age = years_since(user.birth_date)
if age < MIN_AGE_WITHOUT_PARENT and not consents.parental_consent(user.id, feature='tutor'):
return {'status': 'parental_consent_required', 'consent_url': f'/parents/consent?child={user.id}'}
r = client.chat.completions.create(model=MODEL, messages=build(body, age))
return {'reply': r.choices[0].message.content}Engineering guidance, not legal advice. Each provision below may add its own details (a cadence, a deadline, a required notice element): open it for those.
Every rule this guard addresses
Binding law — in force (1)
- IT
- Children under 14 may use an AI service only with the consent of whoever holds parental responsibility (Italy, Law 132/2025 Art. 4(4)) Law 132/2025, Art. 4(4) (parental consent for children under 14)
Informational data, not legal advice. Summaries are TwinEthos's own words and rules have not been reviewed by a lawyer: check the official text before relying on any of it. A guard addresses an item; adding it is not a statement that your code meets any law.
