Foreign AI provider above a legal threshold with no designated domestic representative

Where a law requires an AI provider with no domestic address or office to designate a local representative once it meets a size or reach threshold, the provider checks the threshold each year, designates in writing a representative with a domestic address, files the designation with the regulator, and gives the representative what it needs to act for the provider on the duties the law lists.

The guard to add

Check the threshold each year; if it is met, designate a domestic representative in writing, file it with the regulator and brief the representative on the duties it carries.

A governance record owned by the provider's legal or compliance lead: each year, the inputs for every threshold the law sets (prior-year total revenue, revenue from AI services, average daily domestic users over the last three months of the year, any prior fine for ignoring an order), the outcome, and, when a threshold is met, the written designation of a representative with a domestic address, the filing receipt from the regulator, and the representative's mandate (the submissions, determination requests and compliance support it handles, including checking that safety and reliability documents are current). This is an organizational record, not a code change; a repository can hold its index.

What reviewers look for: a dated threshold assessment for the current year with its inputs; where a threshold is met, a signed designation naming a representative with a domestic address, the regulator's filing receipt, and the mandate covering each duty the law lists.
