Control
An AI or artificial-voice telemarketing call offers no automated opt-out that records a do-not-call request and ends the call
An AI voice agent or artificial-voice call that is telemarketing or introduces an advertisement offers, right after the identification, an automated voice or key-press opt-out with brief instructions; using it adds the number to the caller's do-not-call list and ends the call, and any reasonable revocation (a spoken request, 'stop') is honoured.
Informational data, not legal advice. Summaries and rules have not been reviewed by a lawyer: always verify official law text for decisions. A suggested guard is intended to address each rule; adding it is not a statement of compliance to that law.
Reach
Law in force in United States (federal) (US).
Trust and provenance
How far the rules this guard addresses have been checked. Each rule links to its provision, with its citation, official text and its own panel.
- This control
- Audit-grade: meets all 3 checks of the TwinEthos audit standard that apply to it.
- Lanes
- Binding law — in force 1
- Verification
- Sources last verified 4 Oct 2026; each provision states how.
- Data release
- Data release 2026.10.05, data as of 4 Oct 2026, schema 0.3.10.
- Legal review
- None of the 1 rule has been reviewed by a lawyer; no TwinEthos rule has been legally reviewed yet. Treat each as research to check against the official text; it is not legal advice. Open questions for counsel on them: 1.
- Audit standard
- 1 of 1 rule audit-grade. The audit standard is TwinEthos's own quality bar for provenance, dates, applicability, detectors, fixtures, remediation and licences; it is not a legal review.
- Detectors
- 1 detector, all experimental: written from the rule's text and not yet measured for precision on real code, so treat a hit as a lead to verify. Each provision lists its detectors' known limits.
The guard to add
Give every AI telemarketing call an automated opt-out that records the number to the do-not-call list and hangs up.
Right after the identification line, the agent says how to opt out ('Say stop or press 9 to be added to our do-not-call list'); a DTMF gather or a tool the model must call on an opt-out intent (end_call_and_add_to_dnc) writes the number to the do-not-call list and ends the call, without asking the person to confirm. Voicemail drops include a toll-free number that connects to the same mechanism. Any reasonable revocation heard by the agent marks the consent revoked, and the dialer honours it within ten business days at most (immediately is simplest).
Where it goes: 1 application source code, 6 API calls and integrations, 9 AI output handling, 15 agent action surface.
What reviewers look for: an opt-out gather or tool registered on every telemarketing voice agent, with instructions in the script right after the identification; a handler that writes to the do-not-call list and hangs up; the dialer checks that list and revoked consents before calling.
Example (Python + Vapi), before:
client.calls.create(assistant_id=SALES_ASSISTANT, phone_number_id=PN, customer={'number': lead.phone})After:
assistant = with_opt_out(SALES_ASSISTANT, script='Say stop or press 9 to opt out of future calls.',
on_opt_out=lambda number: (dnc.add(number), consents.revoke(number)))
if not dnc.contains(lead.phone):
client.calls.create(assistant_id=assistant.id, phone_number_id=PN, customer={'number': lead.phone})Engineering guidance, not legal advice. Each provision below may add its own details (a cadence, a deadline, a required notice element): open it for those.
