Mark an AI-altered real estate listing image as altered and link the unaltered original (California AB 723)

From 2026-01-01, a real estate broker or salesperson, or a person acting on their behalf, who includes a digitally altered image in an advertisement or promotional material for the sale of real property must include a reasonably conspicuous statement, on or adjacent to the image, that it has been altered, and a link to a publicly accessible website, URL or QR code that includes and clearly identifies the original, unaltered image; on a website they control, they post the unaltered version (or link it) (B&P 10140.8(a)). A digitally altered image is one altered through photo editing software or artificial intelligence to add, remove or change elements such as furniture, fixtures, flooring, paint, landscape, views or neighboring properties; lighting, cropping, colour correction and similar adjustments that do not change the representation are not (10140.8(b)). Detect listing code that alters images with AI and publishes them without the statement and the original.
